NSW Anti-Discrimination Campaigner and public interest litigant Garry Burns has lodged a number of complaint’s under the NSW Anti-Vilification Provisions of the ADA 1977 ( NSW ) against QLD resident Bernard Gaynor over a number of statement’s he published on the internet that Mr Burns alleged were harmful to homosexual Australians.

“ How could that statement concern serious questions on enrichment toward the Great Conversation in the following ideas claimed by Mr Gaynor as quoted in one of his recent Defence’s filed. ( sic )

 

a. Morality ;

b. Public policy on political freedom ;

c. Religious freedom ;

d. The implied constitutional freedom of political opinion ;

e. The Public interest ;

f.  Threads posed to those freedoms and ideas ;

g. Open and frank participation in the Great Conversations that these issues pertain to.

His above statement goes a step further because it clearly vilifies male homosexuals based on their homosexuality , “ said Mr Burns. 

 

The NSW Supreme Court of Appeal will hear an Application lodged by Mr Gaynor on Wednesday 30 November and and Thursday the 1 December 2016 at 10am challenging jurisdiction and constitution.

 

The court will determine and hear the proceeding involving the matter of an Applicant and Respondent living in different states in relation to the ADA 1977 ( NSW ).

 

“ Basically what Mr Gaynor is legislating for is a right to sit on his computer somewhere in Queensland and publish material on his website / Facebook pernicious to homosexual Australians claiming that I and others who share my characteristic ( homosexuals ) don’t have jurisdiction to lodge a homosexuality vilification complaint against him under any state or territory discrimination or equal opportunity provision because the public act according to Mr Gaynor occurred in QLD and not NSW.

Regarding the public act, the Dow Jones decision states, regarding the internet, an act occurs where the content is downloaded.

The internet crosses all state and territory boundaries and any jurisdictional argument put forward by Mr Gaynor in his application must fail.

This case for me involves a very important question of law to be explored and I will fight for it “ said Mr Burns.

US Supreme Court ruling in favour of same-sex marriage could influence debate in Australia, federal politicians say

Federal politicians say the United States Supreme Court ruling that same-sex couples have a fundamental right to marry could influence the debate in Australia.

Education Minister Christopher Pyne said the ruling, which stops US states from banning same-sex marriage, could not be replicated here.

“It’s not something the High Court could decide on its own,” he said.

But Mr Pyne said it would affect public and political sentiment.

“There appears to be momentum growing worldwide towards marriage equality,” he said.

Mr Pyne said he expects the Parliament will debate the issue of gay marriage before the next election.

“When we come back in spring, there’s every possibility that will be back on the agenda and there’ll be a vote on it and Parliament will either own it or defeat it,” he said.

There are three bills before the Parliament on same-sex marriage: from Labor, the Greens and Liberal Democratic Senator David Leyonhjelm.

But Prime Minister Tony Abbott said the US decision would have little impact on the Government’s approach to the issue.

“What happens in the United States is obviously a matter for the United States, just as what happened in Ireland a few weeks ago is a matter for the Irish,” he said.

“As for our own country, obviously there’s a community debate going on.

“I have views on this subject which are pretty well known and they haven’t changed.”

Opposition Leader Bill Shorten said the decision should spur change within the Liberal Party.

“I invite Mr Abbott again, if the Parliament resumes, to take up the promise that he made and we’ve extended, to have a free vote in the Liberal Party on marriage equality,” he said.

Greens Senator Janet Rice said the US decision gave same-sex marriage advocates within the Coalition more negotiating power.

“I know there are people within the Liberal Party who want to see the Liberal Party have a conscience vote on the issue and I’m sure that the US Supreme Court decision is going to strengthen their hand in their discussions with their Liberal Party colleagues,” she said.

On the 11 June 2015 Latrobe City Councillor Christine Sindt published the below statement on Facebook.
“ Same-Sex marriage “ is an oxymoron. Marriage is defined as a union between a man and a woman. Men and women are different sexes, so how can you have “same sex marriage” ? I wonder what Mr.Chester’s wife thinks about this ? There have been some amazing scandals in British Parliament involving young boys and Parliamentarians”.
NSW Anti-Discrimination Campaigner Garry Burns has taken the action against Ms.Sindt under the Anti-Discrimination Act 1977 ( NSW ) alleging that statement is unlawful because it has a capacity or effect of inciting hatred towards or serious contempt or serious ridicule of homosexual men on the ground of their homosexuality and that act is unlawful.
Mr.Burns successfully sued radio broadcaster John Laws over his “ on air “ rant with stable mate Steve Price in relation to a discussion that homosexual males should not be seen on live television.
Mr.Burns successfully sued Katter Australian Party candidate Tess Corbett over her statement’s linking homosexuality to pedophilia.
Ms.Corbett ran for the Federal seat of Wannon in the 2013 election.
“ For highly distressing reasons , the Australian public at the present day is being made particularly aware of the serious long lasting psychological damage suffered by victims of pedophilia. At any time and especially at this time , and pronouncement that “brackets” ….homosexual people with pedophiles is capable of ….urging ( people) to treat homosexuals as deserving to be hated or to be regarded with serious contempt. Ms.Corbett claims … do not merely offend or insult: they incite these negative reactions”,  said Judicial Member Chesterman in his judgement.
 Mr.Burns said , “ What is it with these incongruous imbeciles in Victoria like Corbett and Sindt. Don’t they realise it’s 2015 and the camp Hollywood legend Miss.Bette Davis is no longer strutting across our once 50’s black and white television set chain smoking. All politicians before entering public life should go back to school and do a course on diversity”.

PROMINENT ALEX GREENWICH SUPPORTER CALLS ON HIM TO RESIGN  – SUCKING UP TO ACON
Noted gay activist GARY BURNS, a former supporter of Member for Sydney ALEX GREENWICH, has today called on Mr Greenwich to resign.Image

Mr Burns door-knocked with Mr Greenwich and former Member for Sydney CLOVER MOORE ahead of the October 2012 Sydney by-election.

But Mr Burns, who donated money to Mr Greenwich’s campaign, and worked on polling booths for him on Election Day, has changed his mind after many months of soul-searching.
“It’s become clear to me that Mr Greenwich is not a true independent Member of Parliament – and the seat of Sydney is known for its independence,” said Mr Burns.
“Mr Greenwich is beholden to the gay Mafioso, and instead of looking after the little people of Sydney, he has become known for attending back-slapping champagne soirees and self-congratulatory gay piss-ups, scoffing caviar in his Zegna suit.
“I’m a gay man myself and nobody supports gay rights more than me – but being Member for Sydney is about being member for everyone in the electorate, not just the gay party set.
“The previous Member for Sydney Clover Moore was a true independent politician. She supported gay rights but she wasn’t in bed with Gay Inc. and the gay Mafioso – she represented all the little issues within her constituency with dedication, purpose and conviction.”
Mr Burns said the last straw was Mr Greenwich “sucking up to ACON”, the AIDS Council of NSW, which acts like a de facto ‘gay government’ and is funded by public money.
In May, Mr Greenwich introduced a motion to NSW Parliament congratulating ACON for reducing HIV in the community.
However in June, NSW Health statistics revealed that HIV had actually jumped by 24 per cent in the last year.
This week, Mr Greenwich was alleged to have tipped off ACON about another Member of Parliament’s inquiries into ACON’s effectiveness.
“I understand Greens MP JAMIE PARKER, the Member for Balmain, had meetings with one of his constituents, who was concerned about ACON’s lack of effectiveness.
“The constituent presented Mr Parker with a petition calling for a review of ACON.”

“Mr Greenwich found out about this and tipped off ACON CEO NICOLAS PARKHILL, who rang Mr Parker and pressured him to drop the matter.
“I call on Mr Parker not to bow to pressure from ACON or Alex Greenwich – he should serve the interests of his constituent in this matter.”
“I also call on Mr Greenwich to resign, effective immediately, because it’s obvious he is not independent – far from it.
“When ACON or anyone from Gay Inc. says jump, Alex’s reply is: ‘How far, sir?’
“That is not independence, that is being a sycophant,” Mr Burns concluded.
Last week, Mr Burns – the man famous for suing broadcaster JOHN LAWS for calling gay men “pillow biters” – won a vilification case against former Katter’s Australian Party candidate TESS CORBETT.
Ms Corbett, who had compared homosexuals to paedophiles, was ordered by the Administrative Decisions Tribunal to make a public apology at her own expense in the pages of the Sydney Morning Herald, and to personally apologise to Mr Burns.
